Maybe I'm a softie, but I like TehRage's idea. I would take it one step further and say that (if possible without causing major problems), their base(s) would be removed as well. That way they'd have to truly "start from scratch".

i think having someone start from scratch is a bit overkill i dont think that if this was TSC or PA or Timber you would say this same thing and Blacky is a hard worker. sure he messed up and xrayed but to penalize him with a start that is worst than someone brand new joining the server is over kill. i say put his diamonds and enchanted books in a prize for a contest let him enter it for free and then if he wins them then ok congrats but if someone else wins to bad good luck for trying but leave his structures alone (also that would hurt me as i use his farms on occasion)

I have no feelings for anyone who breaks the rules. you cheat, you start over. I would expect this for everyone including myself. the only way you stop people from cheating is to make the penalty extreme enough.

Personal Opinions on...

This Specific Situation: It's up to the mods in the end. I don't think black was our worst offender at all, but I also don't think rules should be bent or broken because of the seniority/likability of one specific player.

WWPD (What Would Poster Do): Rollback all changes the player has ever made*, inform the player that the next time they're busted for the same offense they will be permanently banned with no appeal, ban for 30 days.

Gregor's Comment: Unfair, but also accurate. It's no secret that some players are afforded more leeway in following the rules vs. others. We should all be held accountable for our actions equally and if you are someone who happens to get afforded a bit more freedom use that freedom wisely or lose it.

That said, I think I've effectively annoyed enough people here on all sides to pretty much have the book thrown at me if I strayed and got busted. ;)

* This would damage some group builds, such as the Aquadome. Those damages would have to be reviewed on a per-build basis and repaired by a mod. Not an easy task, unfortunately. :/

I second Rage. It has been shown again and again on this server that cheating (especially Xray) is not tolerated and is almost always dealt with a permaban. Blackniph knew this. Having to start over is actually rather lenient in comparison.

Besides, with the amount of public grinders and farms, starting over isn't that hard. And this is Minecraft. It is one of the most stupid-proof games I've ever played. Lose all of your diamonds? Go mine more. Lose your enchanted stuff? Fire up the enderman grinder. (And don't try saying that Blacky can't afford to use dio's grinder. He gets 55 a day from the atm.)

Enchanted books being the things he xrayed to find :p

My last point: I think that some of his builds (most notably the TARDIS) should be left standing. As far as I know, he wasn't the only person that worked on the TARDIS and it would be unfair to the people that helped build it to just tear it down. -Edit- Also goes for the Aquadome, as Poster said.

If I was allowed back on the server after a ban period, I would take any punishment that the MODS seem fit. Make me start from scratch, ok. Let me keep some limited resources or my base, whatever. I just want to let you guys know that I am completely ashamed and sorry for what I did and will take any punishment I receive.

if the TARDIS by the flea market was taken down i would flip out as i built 80% of that and blacky built about 5-10% of it. i honestly think that the worst punishment absolute worst is you take all his stuff and this goes for anyone appealing a permaban. leave structures but take his stuff in chests.

I agree gregor (im sure most of us do). The idea that rage put forward and you have been discussing is a good one Imho. The possible issues with it I see are related to our mods. Most things that require extra work for them will never happen. They lead busy lives and most of the original mods are non-participatory and have difficulty agreeing on controvercial ideas. Many players have multiple storage areas and the work needed to find chests at nonspecific map locations and divest a banned xrayer of all his stuff is considerable. I believd that in terms of "easy" the mods have the options of a permaban, or rolling back most block changes sorted by player.

as far as i know blacky (im sticking with him here because i know him IRL) only has one storage area across from my desert tardis so a mod could just take his stuff like i suggested before and i still like the idea of doing some sort of contest to win banned goods.

While it is very true that myself and the other mods are busy, I do take slight umbrage to this. The hesitance to act is due to a change in perception; specifically, we don't want a change in the perception of x-ray usage. Players have been outright perma-banned for x-raying before. We have taken a very strong stance against it. The x-raying in this case wasn't a first offense, which is why the second ban for this player was permanent. Prior record is taken into consideration when deciding a ban length. If a player has shown a pattern of behavior that's a detriment to the community, that is very much considered. To be clear here, I am not saying that blackniph has been a "detriment to the community," just pointing out how we determine ban lengths. As for the change in perception, we want to make it absolutely clear that x-raying for resources (which isn't even possible anymore) or to find underground locations such as dungeons to raid, is not tolerated at all.

More to the point of this particular ban, I will personally see to it that a decision is reached.

Thanks for the explanation asim0v. A lot of times we are left in the dark regarding some mod decisions and without ever understanding the reasons why a decision was made, most often I assume its because of the added work load. Other than vantes being on 24/7, the mods still seem busy elsewhere and understaffed so the "added workload" is an easy explanation to jump to. If I gave offense, it was unintentional.

After review, it was decided to lift the ban (due to the length since the ban was instated) and to confiscate the books. As of now you ban has been lifted.
